A legal challenge has been filed against President Donald Trump regarding a Truth Social premium service that provides subscribers with accelerated access to his social media posts, which frequently contain government policy announcements capable of influencing financial markets.
The legal action was initiated Wednesday by The Intercept and Freedom of the Press Foundation in Manhattan’s U.S. District Court. Named defendants include Trump, White House Deputy Chief of Staff Dan Scavino, presidential executive assistant Natalie Harp, and the Executive Office of the President.
The commercial offering, known as Truth API, was introduced by Trump Media on August 1. It provides expedited delivery of content from Trump and other prominent Truth Social users ahead of public availability.
Monthly subscription fees range from $60,000 to $100,000. According to Trump Media interim CEO Kevin McGurn, more than 10 organizations have entered into agreements, with the majority being high-frequency trading operations.
Legal Arguments
The complaint contends the premium service infringes upon First Amendment protections by granting preferential treatment to paying subscribers for access to presidential communications that may contain official policy announcements. The plaintiffs maintain that public and media access should be equitable.
Additionally, a Fifth Amendment violation is alleged. The legal team argues that government entities cannot monetize access to publicly available benefits. Neither constitutional claim has yet been adjudicated.
“Nothing could be more antithetical to the free, independent press than the president charging for early access to his public announcements,” said The Intercept Chief Legal Officer David Bralow.
Trump has utilized Truth Social as a platform for announcing trade policy decisions, foreign affairs initiatives, government personnel selections, and military operations. This makes the timing of these communications highly valuable to financial trading operations.
The complaint also highlights Trump’s substantial ownership interest in Trump Media. The Donald J. Trump Revocable Trust controls approximately 41.43% of Trump Media equity, with Trump designated as sole beneficiary. This ownership stake has been assessed at more than $1 billion.
Market Data Licensing and Digital Asset Strategy
Trump Media is currently exploring the possibility of licensing Truth API information to prediction market platforms as an additional revenue channel. McGurn indicated the organization is assessing opportunities within the prediction market sector but provided no specific details regarding the nature of data to be commercialized.
Meanwhile, the company has retreated from previous cryptocurrency initiatives. Trump Media and Crypto.com discontinued plans for a publicly listed CRO treasury entity and ended the exchange’s participation in the proposed Truth.Fi exchange-traded fund offerings.
Trump Media disclosed $360.6 million in unrealized and other accounting losses related to digital assets during the first half of 2026.
Digital Asset Portfolio
The company’s cryptocurrency holdings were appraised at $597.7 million as of June 30. This portfolio comprises 9,477 Bitcoin valued at $557.1 million and 756.1 million CRO tokens valued at $40.6 million.
The lawsuit seeks a judicial declaration deeming Truth API unconstitutional and mandating uniform access to official presidential communications.
