New York Attorney General Letitia James’s office spearheaded the subpoena effort. The document demands extensive documentation across numerous operational areas.
The requested materials encompass marketing tactics, user interaction methodologies, protocols for handling consumer and medical information, programs targeting elderly and underage populations, deep-learning architecture, and corporate governance frameworks.
Investigators are also examining AI sycophancy—a phenomenon where chatbots demonstrate excessive agreement with users instead of providing objective, balanced information.
OpenAI released a statement acknowledging the state officials’ concerns. The organization pledged to work cooperatively with the investigating offices.
“AI is a new and powerful technology, and we work every day to safely bring its benefits to people in a responsible way,” an OpenAI spokesperson said.
Florida Launches Legal Challenge Against OpenAI
Florida made history this month as the first state to file a lawsuit against OpenAI and its CEO Sam Altman. The legal action alleges the company deliberately deployed a hazardous product despite receiving warnings about potential user harm.
Florida Attorney General James Uthmeier initiated a separate criminal investigation in April. This inquiry examines ChatGPT’s purported involvement in a Florida State University mass shooting incident.
Law enforcement officials allege the perpetrator utilized the AI chatbot for planning discussions before executing the attack.
State Regulators Expand AI Industry Oversight
OpenAI isn’t alone in attracting state-level regulatory attention.
Last December, 42 state attorneys general collectively sent correspondence to OpenAI, Meta Platforms, Anthropic, Google, and xAI. The communication demanded enhanced protective measures for at-risk users and emphasized developer liability for damaging chatbot responses.
