The indictment also names sales executives Ruei-Tsang “Steven” Chang and Ting-Wei “Willy” Sun as co-conspirators. According to the Justice Department, the three individuals worked together to circumvent export regulations by shipping servers equipped with sophisticated AI processing components to China.
Details of the Federal Indictment Against Super Micro Executives
The Northern District of California released the unsealed indictment on Thursday, outlining multiple violations of export control regulations. The charging documents accuse Liaw, Chang, and Sun of coordinating “to sell billions of dollars’ worth of servers integrating sensitive, controlled graphics processing units to buyers in China.”
The alleged conspiracy spans activities throughout 2024 and into 2025. According to the indictment, the defendants facilitated approximately $2.5 billion in server sales to a customer based in China. Prosecutors identified an additional $510 million in transactions occurring during a concentrated period between April and May 2025.
Federal authorities stated the executives employed sophisticated concealment methods to evade regulatory oversight. The indictment alleges the defendants created falsified paperwork and presented fake equipment during compliance inspections. Prosecutors claim the group established a front company to obscure the identity of actual purchasers.
James Barnacle, Jr., FBI assistant director overseeing the New York Field Office, characterized the alleged criminal activity. He explained, “These defendants allegedly fabricated documents, staged bogus equipment to pass audit inventories, and used a pass-through company to conceal their misconduct and true clientele list.” Federal officials confirmed that Chang currently remains outside United States jurisdiction.
Both Liaw and Sun faced a federal magistrate following their arrests. Chang, who holds Taiwanese citizenship, has been classified as a fugitive. The Justice Department maintains active efforts to secure his apprehension.

The indictment does not name Super Micro as a defendant in the criminal case. Company representatives emphasized that the alleged conduct runs counter to established corporate policies and compliance protocols. A company spokesperson stated, “The company has been cooperating fully with the government’s investigation and will continue to do so.”
The spokesperson reinforced that prosecutors excluded Super Micro from criminal liability in this matter. The California-based enterprise maintains a market capitalization of $18.5 billion. The firm specializes in manufacturing advanced server infrastructure and data center solutions for major technology companies.
Super Micro counts IBM among its enterprise clients. The company maintains strategic partnerships with technology leaders including Nvidia and Google. Federal authorities made no allegations of improper conduct against these partner organizations.
Super Micro shares experienced gains during standard market hours Thursday. Following the Justice Department’s announcement, the stock reversed course sharply. After-hours trading saw shares decline 13.25% to $26.71.
Legal proceedings will advance in the Northern District of California. Prosecutors have yet to disclose whether additional charges will follow. The Justice Department confirmed the current custody status and ongoing fugitive search as of Thursday evening.
